the problem is i customised the style sheet and I'm sort of stabbing in the dark with what i'm doing.

If you look at my site - click on a section and scroll the 'logo/site title' that sits above the menu scrolls whilst the menu doesn't.

Also if the window is smaller than the content the content moves over the menu when you scroll to reveal more of the body.

I hope this is making sense.

I have created a .header for the logo and title to sit in as it was the only way i could figure out how to align them the way i wanted.

If you look at the site with a smaller browser window than the content it will be self explanatory.

So, how can I make the .header and the menu static and ensure that any body content doesn't scroll over them when someone is viewing the site with a small browser window.

The problem is that you've added your logo to a div#header but it's not inside of the #menu...so it makes sense that it does not work well together. You should simply add the logo via the Pre-Nav area and work from there. The #header div will probably cause much worse issues on IE.
